General conditions of sale for stays in guest rooms " Chambres d'Hôtes de l'Ancienne Auberge ". These general conditions of sale are intended for use in booking stays in guest rooms at "Chambres d'Hôtes de l'Ancienne Auberge", 14610 THAON, France. They constitute the contract of reservation between the owners, Catherine and Marc DECHANT and the customer of a stay in room of hosts.
Article 1 - length of stay : The customer, signatory of the contract concluded for a given duration, will not be able under any circumstance to prevail himself of an unspecified right to the maintenance in the places. The owner may agree to an extension of the stay for a fee if the room is available at the end of the planned stay.
Article 2 - conclusion of the contract : The reservation becomes effective once the customer has sent the owner full payment, i.e. 100% of the rental amount for a minimum stay of one night. Payment implies acceptance of the GTCS.
Under no circumstances may the reservation agreed between the parties be transferred, even in part, to third parties, whether natural persons or legal entities. Prices are inclusive of all charges, including tourist tax.
Article 3 - Absence of withdrawal: For reservations made on the website of "Chambres d'Hôtes de l'Ancienne Auberge" or any other booking channel the tenant does not have a withdrawal period, and this in accordance with Article L121-21-8 of the Consumer Code relating in particular to the provision of accommodation services provided on a date or at a specified period.
Article 4 - Cancellation by the customer: Any cancellation must be notified to the owner by registered post.
If the cancellation is made more than 10 days before the start of the holiday, the payment for the holiday will be returned to the customer.If the cancellation is made less than 10 days before the start of the holiday, the payment for the holiday will be retained by the owners, who reserve the right to claim the balance of the price of the holiday.
If the customer does not show up before 8.30pm on the scheduled start date of the stay, the owners reserve the right to dispose of their guest rooms.

Article 5 - Cancellation by the owner: If, before the start of the holiday, the owners cancel the holiday for reasons beyond their control, they must inform the customer as soon as possible by telephone or e-mail. The customer will be reimbursed immediately for the sums paid. They will also receive compensation at least equal to the penalty they would have paid if the cancellation had been their fault on that date.
Article 6 - Arrival time: The customer must arrive on the day and at the times specified below: Rooms are available from 5.30pm until 8.30pm.In the event of late or delayed arrival, the customer must inform the owner before 5 p.m. on the day of the scheduled arrival.Breakfast is only served in the breakfast room between 8.30am and 10am.
Article 7 - Check-out time: Rooms must be vacated by 10.30 a.m. at the latest. After 12 noon, an additional night will be charged.
Article 8 - Payment: The stay must be paid in full at the time of booking on the owner's website. The price of the room is the same for one or two people (breakfast included).
Payment accepted: credit cards (Visa/Mastercard).
Article 9 - tourist tax : The tourist tax is a local tax that the customer must pay to the owner, who then transfers it to the Treasury. It is payable on the owner's website. The tourist tax is €0.80 per person over 18 years of age per night. The price of the stay includes all taxes, tourist tax and breakfast.
Article 10 - Change of rooms: Without the customer being able to claim any compensation, the owner reserves the right to change the room initially booked by the customer for a room of the same or greater capacity. In this case, the cost of the reservation remains unchanged.
Article 11 - Capacity: maximum 2 people per room. Reservations are made for a specific number of people. If the number of guests exceeds this number, the owner is entitled to refuse additional guests. This refusal can in no way be considered as a modification or breach of contract on the owner's initiative, so that in the event of the departure of a number of guests greater than those refused, no reimbursement can be considered.
Article 12 - Art of living and use of the premises: All guests are asked to respect a certain art of living in order to guarantee the tranquillity of the premises and the comfort of its guests. In addition, "Chambres d'Hôtes de l'Ancienne Auberge" is a non-smoking area and smoking is strictly forbidden in the guest house. Guests are also asked not to eat in the rooms.
The customer undertakes to respect the rules of good manners set out in the rooms and in these GTC. The customer undertakes to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any damage for which he/she may be responsible. Children staying at the property are the sole responsibility of their parents. Outside visitors (parents, children, families, friends of resident guests) will not be admitted to our property. Any behaviour contrary to public decency or public order will lead the owner to ask the customer to leave the establishment without any compensation, without any refund, and after payment of any outstanding expenses. A wifi connection is available free of charge. However, the customer remains responsible for all his downloads.
"Chambres d'Hôtes de l'Ancienne Auberge" has a private courtyard with no vehicular access, it is therefore forbidden to park on the said courtyard.
However, tenants will find around "Chambres d'Hôtes de l'Ancienne Auberge" public outdoor parking.
Article 13 - Animals: Animals are not allowed on our property. This refusal can in no way be considered as a change or breach of contract at the initiative of the owner, so that in case of departure of the customer, no refund can be considered.
Article 14 - Insurance: The customer is responsible for all damage caused by him/her. They must therefore check that their main home insurance policy includes the holiday extension (holiday rental). The hirer certifies that he/she is covered by civil liability insurance covering his/her own liability and that of any persons accompanying him/her.
Article 15 - Liability: The photographs presented on our website are not contractually binding. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate our Guest House give as accurate an idea as possible of the services offered, variations may occur between the time of booking and the day on which the service is consumed. The owner cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the fault of a third party or the fault of the customer, in particular the unavailability of the internet network, impossibility of access to the website, external intrusion or computer viruses. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the customer.
Article 16 - Data Protection: In accordance with the Act of 6 January 1978, you have a right to access and rectify data concerning you. "Chambres d'Hôtes de l'Ancienne Auberge" undertakes not to transmit the information you have provided to other companies or organizations.
Article 17 - Disputes: These General Terms and Conditions of Sale are governed by French law. Only the court with jurisdiction over the location of the Guest House that is the subject of the rental is competent. However, you are reminded that prior recourse to a method of amicable dispute resolution is imposed following the decree of 11 December 2019. Therefore, an attempt at amicable resolution of the dispute must be preferred. These general terms and conditions of sale may be amended at any time without prior notice. Acceptance of and compliance with these general terms and conditions of sale are deemed to have been accepted as soon as the deposit has been paid.
